Thanks for the report. I am not sure why it doesn't produce error in $ or $$, but it is really advisable to use proper grouping for sub- and superscripts with TeX4ht.

Alternatively, you can use the "pic-align" option. It will produce images for align and few others environments, and it doesn't fail with errors.
